NATURE OF THE CASE: This was a dispute over postal authority to not delivery mail and return it marked fraudulent.
FACTS: P ran a mail order business that taught the use the brain and mind to cure sickness. It got 3000 letters per day and about $1600 per day. The postmaster general after a hearing ordered the post office not to delivery P's mail and to return it stamped fraudulent; done under a statute that pertained to a reasonable belief of fraudulent practices. P appealed the order of the postmaster.
