NATURE OF THE CASE: Hays (P) appealed a dismissal of his legal malpractice case against Bryan (D), a law firm and its lawyers who represented P in a federal criminal case.
FACTS: P brought suit in an Illinois court, charging Ds, a law firm who had represented P in a federal criminal case, with malpractice. P was convicted, and did not appeal, and the denial of his motion for post conviction relief under 28 U.S.C. 2255 was affirmed. Ds removed the case to federal district court on the ground that it arose under federal law. The district judge dismissed it on the merits and P appealed.
