NATURE OF THE CASE: This was a dispute over an ICC order that granted a new division of joint rates on traffic interchanged between Kansas City, Mexico and Orient Railway Company.
FACTS: The trial examiner made use of the annual reports of 40 respondent railroads in order to determine the impact of various divisions on carrier revenue and profits. Those reports were never entered into evidence.
