NATURE OF THE CASE: This was an appeal of a conviction for parental nonsupport.

FACTS: Teixera (D) fathered an illegitimate child and for three years after the birth made no support payments. D was charged with neglecting to support the child. At trial, the prosecution presented no evidence of his ability to pay. D was convicted. D appealed; he was indigent and could not pay.
