NATURE OF THE CASE: This was a dispute over a speedy trial.
FACTS: The speedy trial clock began to run with the arraignment of the last codefendant in an alleged drug distribution scheme on September 3, 1980. A motion to suppress was made and the trial did not begin until November 1, 1982. 18 U.S.C. Section 3161 commands that a defendant be tried within 70 days of the latest of either a filing or an indictment or information or the first appearance before a judge or magistrate. This was a dispute over the exceptions allowed.
