NATURE OF THE CASE: This was a ruling from an attorney disciplinary hearing.

FACTS: Graber was arrested by a police officer and changed with DUI. D was informed by the officer that he believed that he had been solicited for a bribe from Graber's attorney, Howard. D met with the officer and directed him to follow Howard's instructions even if those instructions were to testify falsely in favor of Graber. The officer was instructed to make sure the breathalyzer technician would be absent the day of the trial. The officer falsely advised the court that the technician was not available and the charges against Graber were dismissed. The officer was given $50 by Howard, who was later indicted for bribery. The trial judge was informed of what happened in the case. Another attorney bribery case was handled in the same fashion with another officer being paid $250 and testifying falsely under oath. The court was advised of the reasons for this deception. A disciplinary hearing was conducted relating to the conduct of D.
