NATURE OF THE CASE: This was an appeal from a conviction for criminally negligent homicide.

FACTS: Lewis (D) and Sanders engaged in a game of Russian Roulette. D maintained that the gun was unloaded and put away. Sanders again played the game outside of D's presence and shot himself in the head. D was arrested and tried for negligent homicide. D was convicted and appealed; he had not caused the death.
