NATURE OF THE CASE: This was a dispute over the conflicts between state statutes of limitation and the preclusive effect of a federal dismissal under diversity.

FACTS: P sued D in California and the action was removed to federal court under diversity. It was dismissed because of the running of the two-year statute of limitations in California. P then sued in Maryland because of a three-year statute of limitations. D moved for dismissal on res judicata. The action was eventually put in a Maryland State court that granted a dismissal based on the res judicata of the California federal diversity decision. The Supreme Court granted certiorari.
