NATURE OF THE CASE: This was an appeal from a Washington State conviction for theft.
FACTS: Komok (D), age 16, was convicted in Juvenile court for theft in the third degree for aiding and abetting his 14-year-old sister in taking a baseball cap, girls' stretch leggings, and a T-shirt that belonged to Lamont's department store. The sister took the merchandise from the store after D helped her conceal it under a sweatshirt she was wearing. Both parties were stopped. The judge found that D intended to deprive Lamont's of their property. D claims that the information under which he was charged was defective in that it did not include the common law language of intent to permanently deprive.
