NATURE OF THE CASE: This was an appeal of a price control violation.

FACTS: Simon, a salesman of George F. Fish, Inc. (D), knowingly and deliberately sold fruits and vegetables in violation of price control statutes in effect from WW II. The salesman and D were indicted. D was convicted and appealed; it could not be held responsible for the mere acts of an agent.
