NATURE OF THE CASE: This was a dispute over a conviction for a lessor-included offense not charged in an indictment.
FACTS: An indictment alleged that D had defrauded an insurance company by arranging a burglary of his business and by lying about the value of the loss. The trial proof only pointed to the latter crime and the government moved to strike the prior knowledge of the burglary. D opposed that motion. The jury found D guilty and D appealed. The Court of Appeals reversed and the Government appealed.
