NATURE OF THE CASE: This was a dispute over the payment of the mortgage by the estate of Elvis.
FACTS: Alden (P) is the mother of Ginger Alden, the former girlfriend of Elvis. Elvis became aware of P's desire to divorce her husband and Elvis offered to pay all the expenses for the divorce proceeding, to pay off the equity P's husband had in the home and to pay off the mortgage on the house. P filed for divorce on August 1, 1977 and P paid her husband $5,325 in equity and a balance of $39,587.66 remained on the mortgage. Elvis died on August 16, 1977 (a day that will live in infamy). The attorney for the estate informed P that it would not honor the agreement. P sued and lost; the trial court said it was a gift but that it was never delivered. The court of appeals concurred but reversed on grounds of promissory estoppel. D appealed.
