NATURE OF THE CASE: This was a dispute over payment of a construction remodeling project. Bowersock (D) sought review of an order, which entered judgment in favor of Carroll (P) for breach of contract where P partially constructed a concrete floor in a building which burned before floor completion.
FACTS: Carroll (P) agreed to construct a reinforced concrete floor in D's warehouse. P began the project and before it could be completed the warehouse burned down and was totally destroyed without fault of either party. P sued to recover for his performance prior to the fire. P won the verdict and D appealed.
