NATURE OF THE CASE: Clark (D) appealed a judgment, which allowed Marsiglia (P) to recover the whole value of his labor and for materials furnished in cleaning and repairing the owner's paintings even after D cancelled the work on a second painting after work on the first had been completed.
FACTS: D contracted with P to paint paintings. After the work was begun and work finished on one of the paintings, D cancelled. P continued with the work and completed it and then sued D in assumpsit. The court granted P a full recovery on the contract. D appealed.
