NATURE OF THE CASE: This was an action for rescission of an agreement to participate in an illegal investment. Cochran (P) sought to recover money she gave to Dellfava (D) to invest in a chain distributor (pyramid) scheme, which was prohibited by N.Y. Gen. Bus. Law 359-fff(1).
FACTS: Cochran (P) was recruited by Dellfava (D) to invest $2,200 in a 'pyramid scheme' called the airplane game. P lost her monies and sued D to recover.
