NATURE OF THE CASE: This was a breach of contract action.
FACTS: Goodison (P) contracted with Nunn (D) to sell an estate to D in consideration of which D undertook to pay 210. If D did not carry out the contract, D was to pay 21. P sued D for the penalty. P had not conveyed the estate nor offered to do so or taken any steps towards conveyance.
