NATURE OF THE CASE: This was a dispute over the piercing of an LLC entity.
FACTS: Flahive was an LLC with no assets. Kaycee entered into a contract with Flahive to
use the surface of its real property. Kaycee alleged that Flahive caused contamination of
its property and seeks to pierce the LLC and to hold Roger Flahive individually liable for
the contamination. A question was certified to the Wyoming Supreme Court.
