NATURE OF THE CASE: Kilarjian (P) sued Vastola (D) for performance under a real estate contract and then filed a motion for summary judgment.
FACTS: P and D entered into a contract for the sale of D's home with a closing date scheduled for June 15, 2004. On June 14, D's attorney wrote Ps' attorney stating that D had elected not to proceed to convey title. On June 15 P's attorney forwarded a time of the essence letter setting a closing date of June 25. Ds failed to perform. P sued and then motioned for summary judgment.
