NATURE OF THE CASE: This was a dispute over whether punitive damages were appropriate in
a breach of contract action.
FACTS: This was a lawsuit about the termination of an agreement between a brewer and a
wholesaler. This case involved interpretation of Ind. Code Ann 7.1-5-5-9. Several issues
were raised on appeal. The one that was presented in the Re 5th edition was the issue of
whether punitive damages are appropriate in a breach of contract action.
