NATURE OF THE CASE: Miller (P) challenged a decision, which granted summary judgment to NBD (D), grantor's estate, that effectively disallowed P's claim arising from a lease-purchase agreement between P and grantor and a modification of the agreement. The genuineness of grantor's signature on the modification was disputed.
FACTS: This was merely a listing of the Dead Man's Statute used to prevent persons from testifying against an estate as to transactions, acts or conversations of the decedent while the decedent's lips are sealed by death. The public policy is fraud prevention.
