MORROW V. FIRST NATIONAL BANK OF HOT SPRINGS

NATURE OF THE CASE: This was a case involving stolen coins.
FACTS: Morrow (P) and Goslee collected coins. The coins were kept at P's home. The coins
were stolen. P then sued First National Bank of Hot Springs (D) three years later to recover
the value of the stolen coins. P sued under a breach of contract in that D failed to notify
P of the availability of safety deposit boxes in a new bank building. A number of the
employees of the bank had promised to notify P as soon as the boxes were available. Boxes
were available prior to the robbery but P was never informed. A summary judgment was issued
to the bank on that complaint and P appealed.
