MORROW V. FIRST NATIONAL BANK OF HOT SPRINGS 261 Ark. 568, 550 S.W. 429 (1977) CASE BRIEF

MORROW V. FIRST NATIONAL BANK OF HOT SPRINGS
261 Ark. 568, 550 S.W. 429 (1977)
NATURE OF THE CASE: This was a case involving stolen coins.
FACTS: Morrow (P) and Goslee collected coins. The coins were kept at P's home. The coins were stolen. P then sued First National Bank of Hot Springs (D) three years later to recover the value of the stolen coins. P sued under a breach of contract in that D failed to notify P of the availability of safety deposit boxes in a new bank building. A number of the employees of the bank had promised to notify P as soon as the boxes were available. Boxes were available prior to the robbery but P was never informed. A summary judgment was issued to the bank on that complaint and P appealed.
