NATURE OF THE CASE: This was an action for rescission of a contract. Pettit (P), a minor, appealed a judgment dismissing P's action against Liston (D) to recover a down payment made upon the purchase price of a motorcycle purchased from D.
FACTS: Pettit (P) purchased a motorcycle from Liston (D). P was a minor. P paid $125 down and was to pay $25 per month. P used the motorcycle for a month and then returned it, damaged, and demanded his money back. D refused to refund the money and P sued. The action was dismissed by the court and P appealed.
