NATURE OF THE CASE: This was a dispute over the repair of a school building.
FACTS: Cheney (D) had a contract to repair a school building. D bid on the work in haste
and forgot a $963 portion of the work in his estimate. Tyra (P) accepted the contract and D
discovered his mistake after he did some of the work. P sued for a verdict on the express
contract. P won the verdict and D appealed.
