WAGENSELLER V. SCOTTSDALE MEMORIAL HOSPITAL

NATURE OF THE CASE: This was an appeal from a summary judgment dismissing an action for
wrongful termination. Wagenseller (P) challenged a judgment, which affirmed the trial
court's order that granted summary judgment in favor of Scottsdale (D1) hospital and certain
hospital employees in P's action for wrongful termination, but found that the only cause of
action available to P was the claim against her supervisor.
FACTS: Wagenseller's (P) supervisor at Scottsdale Hospital (D1) was Smith (D2). P's
relationship with D2 began to deteriorate when P refused to join in a 'mooning' skit during
a company camping trip. P was terminated and sued D1 and D2; her nonparticipation in the
skit was the reason for her termination. P's action was terminated by summary judgment; an
at-will employee could be fired for any reason. The Court of Appeals affirmed. The Arizona
Supreme Court granted review.
