NATURE OF THE CASE: This was an action for a breach of contract. This was an appeal by Wedner (P) from a judgment for breach of contract that limited damages to the contract terms.
FACTS: Wedner (P) leased security protection from Fidelity Security Systems (D). Under the contract, D's liability for negligence or breach of contract would be limited to the cost of one year's service ($312). P suffered a $46,180 loss due to the failure of D's alarm system. P sued D. P was awarded $312. P appealed.
