NATURE OF THE CASE: This was an action to modify child support.
FACTS: H and W were divorced in 1986 and they stipulated that H would pay $35 per week for each of their two children. H remarried in 1987 and established a new home. W filed a petition for modification of child support. The trial court found no duty by H to support his stepson but it nonetheless ordered H to pay less than what was required under the guidelines. W appealed.
