NATURE OF THE CASE: This was a case involving child abuse and diversity of citizenship.
FACTS: Ankenbrandt (P) sued her ex-husband, Richards (D) and his girlfriend, Kesler (D) for damages for the alleged sexual abuse of P's children. P sued in federal court under diversity and the district court dismissed the complaint. The district court used In re Burrus 136 U.S. 586 for the domestic relations exception to diversity. The Court of Appeals affirmed in an unpublished opinion. The Court granted certiorari.
