APPLICATION OF ROBINSON

NATURE OF THE CASE: This was an application for a writ of habeas corpus to prevent
extradition.
FACTS: Robinson (P) was convicted of burglary in Oregon and sentenced to five years in
the state prison. P was granted parole in order to stand trial in Nebraska. D was convicted
and served 20 months before he was released. The Oregon parole board revoked his parole for
alleged parole violations and attempted to extradite P from Nevada to Oregon. D still had
three years left on his Oregon sentence. D applied for a writ of habeas corpus; he was not a
fugitive because he was compelled to leave Oregon. The writ was denied and D appealed.
