NATURE OF THE CASE: This was a suit about discrimination in housing.
FACTS: Asbury (P) sued under 42 U.S.C. Section 1982 and 42 U.S.C Section 3601 claiming that Brougham (D) refused to rent to her or allow her to inspect or negotiate for the rental of an apartment. The jury verdict went to P for $7,500 and D moved for a new trial and that was denied so D appealed. The issue on review was whether there was sufficient evidence to uphold the verdict and punitive damages.
