NATURE OF THE CASE:
This was an action in replevin. Appealed.
FACTS:
The property at issue is two counters, which initially belonged to Freeland (D). The
counters were installed in Warner's shop in 1867, where they were nailed to the floor.
Warner mortgaged the shop to DeWitt in 1871. DeWitt foreclosed on the mortgage in 1879 and
sold the premises to Chapin (P). D removed the counters from the shop in 1881. P sued for
recovery of the counters. The lower court found in D's favor. P appeals.
