NATURE OF THE CASE: This was a suit in assumpsit for work, labor, and material in a service contract.
FACTS: Clark (D) employed Marsiglia (P) to clean and repair paintings. D countermanded that order but P continued to finish the work and demanded full payment under the original contract. The jury gave the verdict to P for the contract price and D appealed.
