NATURE OF THE CASE: This was a suit to establish an easement by prescription.
FACTS: D owned 1950 acres of land. A dirt road crosses for two miles to the boundary of a
national forest. The national forest had 681 permits for cattle grazing. Ps were the holders
of those permits. They had to use the road that crossed D's property to get to the cattle
grazing area in the national forest. P claimed an easement. The district court gave the
easement. D appealed.
