NATURE OF THE CASE: This was a wrongful death action.
FACTS: This was a wrongful death action against a trucking company with the allegation that it operated a truck with defective brakes. The shop foreman of the trucking company took the stand and testified that all trucks were given an extensive inspection before leaving the shop. However, he had no personal records or personal knowledge about the truck in question and about whether that truck had indeed gone through the shop inspection before being put on the road. P contends that the evidence was inadmissible. P appealed.
