NATURE OF THE CASE: Luis (M) appealed a grant of an order of protection to a mother, on behalf of her child Emily (F), against M.
FACTS: Mother commenced a proceeding on behalf of F, her 13-year-old daughter, alleging that M had committed various family offenses against F. Following a fact-finding hearing, Family Court granted the petition, finding that F and M were in an intimate relationship within the meaning of Family Ct Act 812 (1) (e) and that M had committed the family offenses of forcible touching and sexual misconduct. the court issued a two-year order of protection in F's favor. M appealed. M contends that the Mother lacks standing to bring this family offense proceeding.
