NATURE OF THE CASE: This was a dispute over the burden of an easement by the increased usage of the dominant estate.
FACTS: Hayes (P) brought a chancery action against Aquia (D) because a proposed expansion of the marina would overburden the easement across P's land. P sought an injunction. A commissioner was appointed and that commissioner basically found for D. The trial court ruled for D and P appealed.
