HENLEY V. CONTINENTAL CABLEVISION OF ST. LOUIS COUNTY, INC.
692 S.W.2d 825 (Mo.Ct.App. 1985)
NATURE OF THE CASE: This was a dispute over a license to use an easement in gross.
FACTS: Henly (P) as trustee of the University Park subdivision filed an action for
injunctive relief against D for putting its cable wires and equipment onto easements granted
to the telephone and power companies in 1922. D claims it had a right as it exercised a
license granted by both utility companies. P also sought $300,000 in damages and the
reasonable value of the use of P's property based on quantum meruit. The issue was whether
the easements in gross were exclusive.
