NATURE OF THE CASE: This was a divorce based on incompatibility.
FACTS: W and H had been separated and living apart for 1.5 years. They had violent arguments that involved the police and Family Court. W even put lye in H's food, tried to stab him with an ice pick or knife. W threw a brick through a window. H locked W out of the house on a cold winter day, hit her over the head with a chair hospitalizing her and hit her on two other occasions with chairs. H also kicked her, threatened her with a piece of iron, and threatened to burn the house down. The trial court stated that H failed to sustain his burden of showing that there was no reasonable possibility of reconciliation.
