NATURE OF THE CASE: Class action counsel petitioned for fees and expenses after the suit
was settled for $10.5 million.
FACTS: Counsel represents that they spent more than 7 years on the case on a contingent
basis. They contend that a 30% fee of $3.5 million is fair, reasonable and appropriate.
Counsel seeks expenses of $915,414.01. Counsel contend that the lawyers collectively logged
over 22,397 hours of time for an aggregate lodestar of $8,057,300.50. They contend that they
are requesting less than half the lodestar fee and that this is prima facie evidence of
reasonableness.
