NATURE OF THE CASE: This was an appeal from a termination of parental rights.
FACTS: Jeffrey E. (C) was born to Linda and James E. (Ds). C suffered from pneumonia and was hospitalized and returned home with a regimented treatment program that was essential for his recovery. Ds were unable to follow through and C became ill again and had to be hospitalized. C was removed and placed in foster care and after a hearing, the Court found C to be in jeopardy and that Ds custody should be terminated. When C arrived in foster care, he spoke only two words at seventeen months and was unable to use a cup or spoon. Within a few days in foster care, C showed remarkable improvement. Reunification plans were proposed but the DSS people abandoned them and petitioned the court for termination of parental rights. The rights were terminated and Ds appealed.
