IN RE LEAD PAINT LITIGATION

NATURE OF THE CASE: City of Newark (P) filed a complaint for fraud, public nuisance,
civil conspiracy, unjust enrichment, and indemnification against firms that manufactured
lead pigments or lead paints, or that were the corporate successors to the manufacturers of
those products. Defendants (Ds) moved to dismiss the complaints for failure to state a claim
on which relief could be granted. The trial court issued the order and these appeals
resulted, and the Appellate Division reversed. This appeal resulted.
FACTS: Everyone eventually realized that lead, when ingested, could do serious harm
particularly to young children. Federal, and state legislatures passed many laws to
eliminate the usage of lead in home based paints, furniture, and toys.
