NATURE OF THE CASE: This was an appeal from a probate court order allocating responsibility for estate taxes. The state government challenged a judgment, which held that the state was liable to the county government for the inheritance tax due from the estate of a deceased county resident whose property escheated to the state for a lack of heirs.
FACTS: The probate court found that O'Connor's estate escheated to the State of Nebraska for want of heirs, and assessed estate taxes against the State (D) in favor of Adams County (P). The State appeals.
