NATURE OF THE CASE: This was a negligence action. Misericordia (D) appealed from a judgment for Johnson (P) in an action alleging Ds were negligent in granting a physician specialized surgical privileges.
FACTS: Johnson (P) sued Misericordia Community Hospital (D) for negligently hiring Dr. Salinsky and allowing him to perform surgery on P's hip. P sought to introduce records and testimony regarding the refusal of other hospitals to allow Dr. Salinsky on staff. P offered evidence and testimony regarding restrictions imposed on the Dr. by other hospitals. The trial court allowed the evidence over D's objection. D appeals. P contends that the evidence is offered to prove that records existed regarding the competence of the Dr. and that D was negligent in not inquiring about the content of those records.
