NATURE OF THE CASE: Meyers (D)appealed a judgment upholding a jury conviction of suborning perjury, in violation of Title 22, 2501, D.C. Code (1940).
FACTS: Meyers (D) was on trial for perjury. The government (P) had a witness testify and summarize statements made by D's codefendant. D objected to this testimony, claiming that instead, a transcript of the codefendant's actual testimony should be used under the best evidence rule. The judge overruled D's objection. P's witness testified as to the codefendant's statements. The testimony resembled the summations of the indictment. D was convicted of suborning the codefendant's perjury. D appealed.
