NATURE OF THE CASE: This was a case involving a transsexual seeking support.
FACTS: M.T. (P) filed a complaint in Juvenile and Domestic Relations Court for support and maintenance. J.T. (D) interposed as a defense that P was in fact a male and that the marriage was void. P had in fact undergone a sexual change operation. D was aware of P's prior identity and married P after the operation. A trial judge determined that P was a female and D was her husband and that D was ordered to pay $50 per week on support. D appealed.
