NATURE OF THE CASE: This was a suit for deficiency upon a mortgage bond.
FACTS: P had a mortgage bond of $8,000 made by D. P had to foreclose upon the bond and after the sale of the property there was still a balance due and owing on the bond of $3,877.53. D then filed a common plea with the remaining balance due based on the fact that the Court of Chancery decreed that that amount was still due and owing. D appealed.
