NATURE OF THE CASE: These are two cases joined for appellate consideration from two
separate state convictions for manufacturing marijuana.
FACTS: In both cases, police officers got tips that individuals were growing marijuana on
their property. While the marijuana was on the people's property, the patches were in an
open field and in the middle of a wooded area, respectively, located some distance from each
person's home. Police officers walked through the areas, past a no trespassing sign, and
eventually discovered the marijuana on the people's property. D's were convicted in their
respective trials and appealed.
