NATURE OF THE CASE: This was a dispute over an occupancy permit.
FACTS: Penobscot (P) applied for an occupancy permit for a house to hold six retarded adults and two full time employees. The Brewer (D) code enforcement officer denied the permit because he concluded that P did not meet the terms of D's zoning ordinance as a single family. P appealed that decision to the City's Board of Appeals and it was affirmed. P sought review by the Superior Court. It affirmed. P appealed.
