2001 Fake Case (2001)
NATURE OF THE CASE: Davis (D) appealed the granting of an injunction to enforce a
recorded covenant that was to run with the land and bind future owners.
FACTS: Perry (P) and his neighbor Alice hated cats. In 1990, they agreed and covenanted
that no cat would be kept on either of their residences. It expressly stated that the
covenant would run with the land and would bind and benefit future owners. They even
properly recorded the covenant. When Adams passed away Davis (D) got the residence for
life. D kept six cats on the property. P sued D for injunctive relief to enforce the
covenant. P got the injunction and D appealed.
