NATURE OF THE CASE: Archambault (D) appealed an order, which ordered the removal of a portion of their home that encroached on the land of Peters (P).
FACTS: Archambault (D) owned a house that was built partially on P's lot. D was innocent of any wrongdoing other than not discovering the problem prior to his acquisition of the title from his predecessor. Both lots were registered. The encroachment was discovered just twenty years after it was made. The trial judge ordered the encroachment removed. D appealed.
