NATURE OF THE CASE: This is yet another in the continuing saga of sodomy cases.
FACTS: D was convicted of criminal solicitation to commit sodomy. D was fined $500 and sentenced to six months county jail. His conviction was affirmed. The Court of Appeals denied discretionary review but the Supreme Court of Kentucky granted that review. D contends that the local ordinance conflicts with the state ordinance as the local one provides greater penalties.
